Registration and foreign funding are separate issues
An organisation can be properly registered and still need to address separate requirements relating to foreign contributions. The legal review should consider the organisation’s structure, donor, project, funding route and the applicable policy framework.
Review the funding arrangement before receipt
Donor agreements, project descriptions, budgets and banking arrangements should be checked before funds are received where regulatory approval or documentation is required.
The policy position should be checked at the time
The Economic Affairs Division publishes the policy framework for local NGOs/NPOs receiving foreign contributions. Organisations should check the policy and any later government directions in force when the funding is proposed.
